Family Says NJ Overreacted to Boy’s Gun Photo [POLL]

A New Jersey family claims a Facebook photo of their son holding a rifle his father gave him for his upcoming 11th birthday led the state's child welfare agency to their home, demanding to be let inside and inspect their guns.

The family of Josh Moore asked caseworkers and police to leave their Carneys Point home last Friday because they did not have a search warrant.

Attorney Evan Nappen says a child welfare worker refused to identify herself before leaving.

The case has riled gun-rights advocates, who say the family was defending its constitutional right against unreasonable search and seizure.

A spokeswoman for the child welfare agency says she cannot comment on the report because of confidentiality requirements, and police weren't talking.
